Agreement to these Terms

ListenCat is a service of Hunai LLC (“Hunai,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be legally able to enter into this agreement in your country. If you use the Service for an organization, you confirm that you have authority to bind that organization.

ListenCat is a general-audience service and is not specifically designed or marketed for children. If you are under the age of legal majority where you live, a parent or legal guardian should review these Terms with you and supervise your use of the Service.

What ListenCat provides

ListenCat provides tools that can turn supported text and reading material into speech, manage playback, and remember reading preferences and progress. Features may differ by device, operating system, region, release, or subscription level and may change over time.

Some features require internet access or third-party services. We do not guarantee that every document, website, book, voice, or third-party service will remain compatible or continuously available.

Your content and permissions

You retain ownership of content you provide or access through the Service. You grant ListenCat the limited permission necessary to process selected content, generate audio, and provide the features you request.

You are responsible for ensuring that:

• you own the content or have permission to access, process, and listen to it;
• your use respects copyright, licensing, access-control, and other applicable laws;
• you do not use ListenCat to distribute or make unauthorized copies of protected content; and
• you do not bypass digital rights management, security controls, or usage restrictions.

Amazon and Kindle support

ListenCat may allow you to open and listen to eligible content that you lawfully access through an Amazon service. ListenCat does not sell, license, host, or provide Kindle books, and it does not grant you any rights to Amazon content. You must use your own Amazon account and comply with the terms, content licenses, geographic restrictions, and other rules that Amazon applies to its services and content.

Amazon controls its services, accounts, content, and availability. Changes made by Amazon may affect or disable related ListenCat features. Questions about an Amazon account, purchase, or content license must be directed to Amazon.

Acceptable use

You may not use the Service to:

• break the law, infringe another person’s rights, or process content you are not permitted to use;
• interfere with, overload, probe, reverse engineer, or compromise the Service or another service;
• circumvent technical restrictions, access controls, subscriptions, or security protections;
• introduce malicious code or use automated means to scrape or abuse the Service; or
• resell, sublicense, or commercially exploit the Service unless we agree in writing.

We may restrict or end access when reasonably necessary to protect users, third parties, or the Service.

Accounts

Some features may require a ListenCat account. You agree to provide accurate information, keep your sign-in method secure, and promptly notify us if you believe your account has been used without permission. If you sign in through another provider, your use of that sign-in method is also subject to the provider’s terms.

You may request account deletion through the app where available or by contacting us. Deleting a ListenCat account does not automatically cancel a subscription billed by an app store or another payment provider; you must cancel it through the provider that manages the subscription. Account deletion also does not create a right to a refund except where required by law or the applicable payment terms.

App stores and third-party services

If you obtain ListenCat through the Apple App Store or Google Play, your use is also subject to the applicable store terms, rules, and policies. Where these Terms conflict with mandatory store terms, the mandatory store terms control. Apple and Google are not responsible for third-party services accessed through ListenCat.

If you download ListenCat through the Apple App Store, your license to use the app is also subject to Apple’s Standard End User License Agreement, unless a custom license is provided through Apple. These Terms additionally govern the ListenCat Service and your relationship with Hunai LLC.

Third-party services have their own terms and privacy practices. ListenCat is not responsible for a third party’s content, availability, security, purchases, or conduct. Your relationship with a third party is governed by your agreement with that party.

Purchases and subscriptions

ListenCat includes free features and may offer optional subscription-based features. Prices, billing periods, included features, taxes, and renewal terms will be shown before purchase. Subscriptions may renew automatically until canceled using the method described at purchase.

Purchases made through the Apple App Store or Google Play are billed, renewed, canceled, and refunded under the applicable store’s rules and your store account settings. Unless required by law or the store’s rules, Hunai cannot directly issue refunds for purchases processed by Apple or Google. If web billing is offered in the future, the checkout page will identify the payment terms, cancellation method, and refund rules that apply to that purchase.

Intellectual property

The Service, including its software, visual design, brand, logos, and original materials, is owned by or licensed to Hunai LLC and is protected by applicable intellectual-property laws. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. They do not transfer ownership of the Service or third-party content to you.

Service changes and availability

We may add, change, suspend, or discontinue features, integrations, or the Service. When practical, we will provide reasonable notice of changes that materially reduce a paid feature. You are responsible for maintaining backups of material that you are entitled to copy. We are not responsible for losing access to third-party content or services.

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Generated audio, timing, and accessibility features may contain errors and should not be relied on for emergencies, professional advice, or other high-risk uses.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Hunai LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, content, profits, goodwill, or access to a third-party service arising from your use of the Service. Any limitation applies only to the extent allowed by the consumer law that applies to you.

Ending use

You may stop using the Service at any time and uninstall the app. We may suspend or terminate access if you materially or repeatedly breach these Terms, create risk or harm, or if we must do so for legal or operational reasons. Provisions that by their nature should survive termination will remain in effect.

Changes to these Terms

We may update these Terms to reflect changes to the Service, third-party requirements, or applicable law. We will post the revised Terms and update the effective date. Where required, we will provide additional notice or ask for consent. Continuing to use the Service after revised Terms take effect means you accept them, except where the law requires a different form of agreement. Changes do not remove rights or obligations that cannot lawfully be changed without your consent.

Governing law

These Terms are governed by the laws of the State of Delaware and applicable federal laws of the United States, without regard to conflict-of-law rules. Courts located in Delaware will have jurisdiction over disputes, except where applicable law gives you the right to bring a claim elsewhere. If you live outside the United States, you keep any mandatory consumer protections provided by the laws of your country.
